TERMS & CONDITIONS FOR TOURS, TRAINING, RENTALS, AND BOOKINGS

TOUR OR RENTAL BOOKING

RIDE Adventures, LLC., registered with the State of Florida, U.S.A. as a Seller of Travel, Registration No. ST37927. RIDE Adventures, LLC is a tour operator specializing in motorcycle tours and 4x4 adventures for groups and individuals alike. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you book your trip through us, in addition to important obligations you make as a customer that affect your legal rights. The terms “we”, “us”, “our”, “RIDE” and “Tour Operator” refer to RIDE Adventures, LLC (hereafter referred to as “RIDE.”) The terms “you”, “your”, “passenger”, “participant”, “guest”, and “customer” refer to the customer visiting our website, and/or booking a reservation through us. 

RIDE cannot accept any tour or rental customer without these terms & conditions being accepted. You also confirm that you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and the information supplied by you or members of your group is true and correct. You understand that you are financially responsible for any use of our services or website by you and those for whom you make bookings. Please be sure to read these Terms and Conditions carefully. All customers must be 18 years of age or over, or have a separate agreement completed by a parent or legal guardian in order to participate in any tour or rental. 

YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS

By booking your arrangement with us, you are agreeing to be bound by the terms of this Agreement and any additional terms and conditions of any Supplier that are applicable to your travel arrangements. The lead participant assumes the responsibility of sharing these Terms and Conditions with each trip participant, including payment of all amounts when due. It is the responsibility of each participant to read our Terms and Conditions in its entirety. RIDE is not responsible for any participant’s unawareness of the Terms and Conditions due to the failure of the lead participant to share this information with all other participants. If you do not agree with our terms and conditions you should contact us before making a booking.

You acknowledge and agree that we may change these terms and conditions from time to time and that those changes become effective immediately. You agree to be bound by the terms and conditions that are in effect at the time of your travel or cancellation, whichever applies. You agree that it is your responsibility to be familiar with these terms and conditions and to check back from time to time for any changes.

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.

RELEASE AND WAIVER

All customers of tours or rentals will be required to accept and sign a release and waiver of rights as presented by RIDE or the equipment rental company (if applicable to your booking), which will not accept any customer without a duly signed release and waiver. A copy of the release and waiver form can be provided in advance upon request.

RESERVATION PAYMENTS & DEPOSITS SCHEDULE

  • Reservations made 90 days or more before the start date of any booking requires an initial  deposit as outlined below. This deposit secures a place on the tour and/or the customer’s equipment rental, as applicable:
    • Reservations under $1500 require a $250 deposit per person.
    • Reservations equal to $1500 or more require a $500 deposit per person.
    • Reservations for travel outside North America require a $1000 deposit per person.
    • Route or Itinerary Customization and Reservation Change fees: Services estimated at less than $1000 must be paid in full before customization work begins. Services that involve vehicle and/or hotel reservations estimated at over $1000 require a minimum $1000 deposit ($1500 for travel outside North America) before customization work begins. Change fees may be applied for alterations to reservations once they are confirmed.
  • Once your reservation is confirmed, your deposit becomes non-refundable and/or subject to the terms for cancellations or refunds as outlined below. 
  • The total cost (100%) of any remaining balance is due 90 days before the reservation start date, as applicable. If the total balance is not received 90 days before a reservation start date, the reservation may be considered canceled, and RIDE reserves the right to charge the cancellation fee set forth below. For bookings made with less than 90 days until the requested reservation start  date, full payment is due in order to make the reservation. No reservation will be considered confirmed until deposit and/or full payment is received by RIDE, and written confirmation of said booking is communicated to the customer. 

Customers are required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, email address, telephone number, date of birth, pricing, arrival/departure airports, arrival/departure dates, accommodations, and organized activities on your booking receipt. Please notify us immediately if any omissions and/or corrections are needed regarding the booking details. Customer voluntarily assumes full and sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. Customers are required to verify the accuracy of the customers’ LEGAL first & last names. It is mandatory that names given be identical to the customer(s) LEGAL first and last names and identical to the names as they appear on booking and travel documents such as passports, licenses, etc.

CANCELLATION AND REFUNDS

Each customer requesting cancellation must inform RIDE immediately in writing. Upon receipt, RIDE will follow best practices and begin processing any applicable refunds according to the following schedule:

  • Initial $250/$500/$1000/$1500 deposits and Route or Itinerary Customization services are non-refundable. 
  • Cancellations received between 89 and 45 days prior to the date of any tour or rental are subject to a cancellation fee of 50% of the total booking price, but no less than the initial deposit as indicated above.  
  • Cancellations received less than 45 days prior to the date of a tour or rental, as well as no-shows for any reason, are subject to a cancellation fee of 100% of the total tour or rental price. 

In the event of trip cancellations due to Covid-19 or other variants, pandemics, Force Majeure, etc. any recoverable or avoidable costs will be refunded where possible. In the event of the above, or other extreme circumstances such as medical, injury, or other preventing participants from fulfilling their reservation, RIDE will, at its sole discretion, consider the issuance of credit toward future tours or rentals. No refunds will be given for early return of equipment during a rental or tour. 

In addition, RIDE may be required to pay suppliers well in advance of the customer’s booking start date. Suppliers may have their own cancellation policies, which, particularly in the case of peak seasonality, special events, or customized plans, may include immediate non-refundability upon reserving, and such cancellation policies apply to your booking. If you are entitled to a refund, please note that the supplier may be responsible for this refund, not RIDE. Generally, flight tickets, hotel reservations and other items provided for travel cannot be refunded if they are partially used. RIDE is not responsible for a supplier’s failure to pay a refund.

PRICING

Unless otherwise stated, quoted prices are in U.S. Dollars and are subject to change without notice.    

For your convenience, we accept multiple forms of payment including checks drawn from a US bank, wire transfers, and major credit cards and debit cards.  

While we do accept major credit cards, you must provide to us a signed charge authorization agreement for every transaction for your trip that we process on your behalf. Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback (excepting fraud) in the case of cancellation for any cause whatever, including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in these Terms and Conditions. In the event a participant attempts to chargeback, reverse, or recollect a trip payment already made without the authorization of RIDE, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback, reversal or recollection, including, without limitation, attorney fees.

If cost factors, including but not limited to hotels, meals, rental equipment, insurance, international currency fluctuations etc., dictate the need for fare increases, RIDE may do so at any time prior to 90 days before departure. All route and itinerary customization services are billed at $75 per hour.

GROUP TOURS

What’s Included

Motorcycle and/or 4x4 Rental or other specified Equipment: As detailed in the itinerary. Upgrades are available for an additional fee. Rentals include all equipment and 3rd party liability insurance as detailed in your individual itinerary.

Tour Accommodations: Accommodations are priced on either single or double occupancy basis according to your itinerary. Standard rooms with private facilities will be provided at the property specified or similar. Rooms will be assigned by the respective supplier/s on a run-of-the-house basis, in category/ies as specified in the itinerary. Special requests such as single rooms, lower floors, connecting rooms and smoking preference, must be made at the time of booking. While we will make reasonable efforts to communicate your requests to the supplier, such requests are not guaranteed and are at the discretion of the supplier. There may be additional charges for such requests which will be solely the expense of the guest making the request.

Guests should be aware that hotel room sizes, standards and facilities can vary regionally and are often different from standards in the United States. This can include differences in bed sizes and room sizes, bathroom amenities, amenities such as air-conditioning and compliance with other standards such as ADA and wheelchair accessibility. 

RIDE reserves the right, if necessary, to substitute other similar hotels for hotels listed. Such substitutions may be made at any time and without prior notice. RIDE cannot be held responsible for hotel over-bookings; should such occur, RIDE will undertake to find similar accommodations in the same area. Such substitutions are at our sole discretion and no refunds are promised for changes in accommodations.

Guests should be aware that star ratings or similar systems are based on country classifications and therefore can differ. While RIDE does its best to maintain current and accurate information regarding these suppliers, we cannot be held responsible for any inaccuracies in supplier descriptions, amenities, or images.

Transfers: RIDE is pleased to offer transfers in accordance with your individual itinerary. You must be on time for all transfers. There will be no refund for missed or unused transfers. You must provide us your flight information no less than 14 days prior to departure to ensure transfers will be available. If at any time your flight plans change, you must notify us immediately. Failure to do so may result in missing these services and no refund shall be due for missed arrival transfers resulting from missing or outdated flight information.

Meals: Meals are included as indicated in the itineraries. Special diets should be requested at the time of booking; however, it may not be possible for special diets to be catered to in some of the destinations we feature. For safety and liability reasons, RIDE and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and is not responsible for any issues or problems associated with the same. We will advise the hotels and other accommodations of your request but we cannot guarantee their availability.

Sightseeing: Sightseeing is a main event of our tours and individual itineraries detail most of the magnificent sites you will be visiting. As a courtesy to others on the tour, it is mandatory that you be on time for every departure. We will begin on-time and failure to arrive will be considered a no-show for which no refunds will be available. It is essential that you keep in mind that the schedules are set to accommodate climate, traffic, and best viewing options for our groups. At times, early morning departure times may help create a better experience. Therefore, late arrivals cannot be accommodated.  

While no changes are anticipated, there may be occasions when certain alterations become necessary. These can be due to religious holidays, national celebrations, or unforeseen events including weather, governmental closures, Acts of God, or any other reason. RIDE reserves the right to change the itinerary due to such unforeseen circumstances or emergencies. These changes will not be considered a material changes and will not be considered cause for cancellation by the guest. If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.

What’s Not Included

Any items and matters not referred to in your itinerary are not included in the tour price. This can include, but is not limited to items such as flights, checked and/or excess baggage; passport and visa fees; trip protection and/or insurances; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; optional experiences; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the guided tour whether of your own volition, our decision based on behavior that disrupts the trip, due to illness, action by any government, or other reason. This list is illustrative and not a complete list of every item not included.

EQUIPMENT RENTAL AND SECURITY DEPOSIT (APPLICABLE TO MOTORCYCLE TOURS AND RENTALS)

RIDE always reserves the make and model of equipment requested by all customers, but reserves the right to change this reservation in extreme circumstances. Extreme circumstances include, but are not limited to, mechanical failure, collision, damage and theft. Should RIDE not be able to replace the confirmed equipment with the confirmed type or similar, a prorated refund for the difference in models will be refunded to the customer. This constitutes the maximum liability of RIDE. A security deposit must be blocked on the customer’s major credit card or paid in cash at the tour or rental operator’s location at the time of pick-up. The amount of this security deposit will be indicated in advance during tour or rental quotation. RIDE and its tour and rental operators reserve the right to adjust the amount of this security deposit without notice. This security deposit will be refunded upon return of the undamaged equipment to the rental center. The rental period is not considered interrupted due to the inability of a customer to ride or the breakdown of equipment for any reason. During a tour or rental, RIDE is not obligated to replace damaged equipment, but will make every reasonable effort to have the tools, parts, and everything necessary to keep all rented equipment operating safely for the duration of the customer’s trip.

LUGGAGE

RIDE assumes no responsibility for loss, damage or delay in the transport or handling of luggage of customers. Luggage transported by RIDE each day is done so at customer’s own risk. RIDE will give the guidelines as to what amount of luggage can be accommodated per person depending on the options included in the customer’s tour or rental. Luggage insurance is recommended along with trip cancellation insurance.

TOUR CANCELLATION DUE TO INSUFFICIENT NUMBER OF CUSTOMERS

In the event the minimum number of customers are not reserved for a tour, RIDE will offer to operate the tour if all customers agree to a supplemental charge due to the low number of tour customers. If all customers do not accept to pay the supplement, RIDE will offer any alternative travel arrangements available to customers. If alternative travel options are not mutually agreed upon, RIDE will refund amounts paid to customers. This refund applies only to non-private tour group reservations. Custom or private group reservations will have to have a specific minimum number of customers agreed upon during the pricing and quotation process, with pricing adjustable according to the number of participants and/or inclusions promised. In the event of trip cancellation due to insufficient number of customers, RIDE is not liable for any additional costs or losses incurred by the tour customer. This includes, but is not limited to, the cost of airline tickets, hotel reservations and automobile rentals. Situations may arise which, in our opinion, make it necessary for RIDE to cancel, advance or postpone a scheduled tour, change itineraries or make substitutions regarding hotels, cities, tour guides and other travel arrangements. In each situation, RIDE does not assume responsibility or liability for any resulting losses, expenses or inconvenience. RIDE is not required to make refunds once a tour or rental commences, regardless of the reason for customer’s being unable to complete the tour. 

NON-OBSERVANCE OF TRAFFIC LAWS AND BEHAVIOR

If the customer does not comply with traffic laws or the requirements for group travel, or a customer’s behavior is considered dangerous to other group members, pedestrians, or the public in general, or if a customer’s behavior renders customer unfit for the trip or unfit for continuation of the trip, the contract may be canceled by RIDE or its partners and the rental equipment secured. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate, offensive or interferes with the delivery of services, or may constitute a hazard or embarrassment to the customer or any bystanders. In any such case, RIDE is under no obligation to refund any unused portion of a customers’ trip. RIDE is not responsible for the behavior of other tour participants toward the customer. Issuance of traffic citations or the suspension of a vehicle operator’s permit before, during, or after a tour or rental period are not the responsibility of RIDE, and do not warrant any type of refund for any portions of the tour or rental reservation period lost as a result.

Customer is responsible for any damage or loss caused by the customer. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the owner or manager of the accommodations or other suppliers. Customermust indemnify us for the full amount of any claim (also including legal costs) made against us. RIDE is not responsible for any costs incurred concerning a guest removed from a vacation/holiday. Customers agree not to hold RIDE or any of its related entities liable for any actions taken under these terms and conditions.

PHOTO AND VIDEO MATERIAL

Photos, videos and other media produced by RIDE or its representatives with cameras or equipment owned by RIDE or its employees, contractors, suppliers, or staff during tours, rental or training operations are and remain the property of RIDE and the copyrights rest with RIDE. RIDE retains the right to use all such material for advertising and marketing purposes, including images in which individual tour or rental customers can be recognized, without any charge from the tour member for RIDE to use this material.

INTERNATIONAL TRAVEL, PASSPORT, VISA, DRIVING AND HEALTH REGULATIONS

Customers are responsible for complying with above regulations and all consequences resulting from non-compliance for all countries traveled in. It is strongly encouraged that each customer reviews in advance the visa, passport, and vaccination requirements of both the customer’s country of passport nationality, and each country to be traveled through to ensure compliance. Prior to booking international travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such a destination is safe or without risk. For information concerning possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov, and click on “Travel Warnings.” For medical information, we recommend contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. If the traveler still chooses to travel to the locale of a warning, the traveler assumes all risk of personal injury, death or property damage that may arise out of or which relates to the type of events warned against. 

A valid passport is required for all citizens. Passports must be up to date with an expiry at least 6 months after the trip return date. Many countries also require that your passport have at least two completely blank pages. For up to date visa requirements US citizens should visit www.travel.state.gov, and citizens of other countries are advised to visit the appropriate sources of such information regarding their travel requirements.

When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Examples: DHS designated enhanced driver’s license, U.S. Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. For more information you can visit the TSA website at https://www.tsa.gov/travel/security-screening/identification.  

Citizens of other countries require a valid passport and may require additional documents. Such persons should contact consulates of countries to be visited and obtain proper documents before departure. The possession of required and valid passport and visa is the sole responsibility of the traveler. RIDE assumes no liability for lack of proper documents.

It is essential that you see your physician before booking your trip and before traveling to make sure that you have taken all necessary health precautions. Some vaccinations require more than one visit with a period of weeks between injections. You should visit your physician at least 6 weeks before departure. For up to date medical advice we strongly recommend that you visit the Centers for Disease Control and Prevention (CDC) travelers’ health page: www.cdc.gov/travel or for non-US citizens, your country’s equivalent.

It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc. that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete.

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc. We recommend that you keep a copy of your scanned passport (photograph page) in your email or other digitally-retrievable source while traveling. 

Any failure of a participant to have proper visas and/or passport will likely result in the participant not being able to leave the country or enter a destination and no refund will be available in any such case and the Tour Operator will have no liability in such case.

Disinsection: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transportation’s Disinfection Information page on their website at the time of booking for further information: https://airconsumer.dot.gov/spray.htm

RIDE will not be responsible for any portions of rentals or tours or other travel-related costs lost due to inability to enter countries or comply with the laws of each country. Each customer must have a valid operator’s permit from their state, province, or nation of residence for the specific type of equipment they will operate during their motorcycle tour or rental. This permit will need to be physically present and verified at the time of equipment pick-up.

RESPONSIBILITY AND TOUR COMPLETION

RIDE is responsible for providing the services listed according to the description of services shown in the tour or rental pricing quotation. RIDE is not responsible or liable for: 1) any delay or cancellation of a flight that causes you to miss any portion of the trip or rental, 2) any defect in or failure of any vehicle, craft, equipment, or service of any travel supplier, or 3) any wrongful or negligent acts or omissions on the part of any other party not under control of RIDE, including but not limited to airlines such as Aerovias DAP, hotels, car rental companies, and suppliers of equipment, all of whose names are disclosed in your itinerary, price quotations, or our promotional material. 

ADDITIONAL RISKS

Additional risks and dangers may arise including, but not limited to, hazards of travel by, motorcycle, 4x4 vehicle, train, automobile, motor coach, aircraft and other means of conveyance; hazardous conditions on the road including narrow roadways, dirt roads, hairpin turns, travel in areas where roads are not maintained, potholes, slippery surfaces; malfunction of equipment including helmets or other safety equipment; your failure to wear a helmet; mechanical failure; animal interactions, forces of nature, political unrest, other unrest, risks associated with water, food, alcohol, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved and you hereby agree to accept any and all risks. As lawful consideration for the agreement with RIDE to participate in such trips and activities you agree you will not make a claim against RIDE, its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release RIDE, its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.

WEATHER CONDITIONS & RIDER CAPABILITY (APPLICABLE TO MOTORCYCLE TOURS AND RENTALS)

RIDE and the operators it represents makes every effort to schedule tours at a time of year when the weather is best for touring. Many tours pass through areas where weather conditions can change quickly and significantly. RIDE cannot be made liable for unpleasant or unsuitable weather conditions and no refunds are made for such conditions. It is strongly encouraged that customers consult with RIDE in advance to confirm that both the customer’s riding ability and choice of protective riding gear are appropriate for the type of tour or rental experience being planned. In the event a tour or rental is being confirmed for a period that would typically not be good for riding, RIDE is not responsible for any extra costs incurred due to delays or cancellations of the tour, as the possibilities of this inclement weather have been communicated to the customers before reservations were made.

PROTECT YOURSELF

It is strongly advised that customers have adequate travel protection coverage for your tour. Such a plan at a minimum should cover Trip Cancellation or Interruption, Cancel for Any Reason, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. 

RIDE is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel protection plans. RIDE cannot evaluate the adequacy of the prospective insured's existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker.

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. RIDE cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason.

RIDE also strongly recommends that customers have adequate medical and accident insurance prior to departure.

Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses however arising, for which trip protection plan coverage would otherwise have been available.  

YOUR HEALTH

Travel adventures can require a high-level of both physical and mental conditioning, and it is strongly recommended that customers consult with a doctor prior to making reservations for confirmation that the customer is in sufficient condition to endure such a trip. RIDE reserves the right for itself, and its guides, the right to dismiss anyone from a tour, who at the sole discretion of RIDE and its agents is determined unable to complete or participate in a tour due to health reasons.

The nature of many of the destinations we travel to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of your participation in any of our tours. 

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your trip, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. RIDE will make reasonable efforts to accommodate requests, but cannot be responsible if ADA accommodations are not available. Any accommodations provided will be at the sole expense of the guest requiring the accommodation. RIDE, its tour guides, leaders and suppliers are, unfortunately, unable to offer additional assistance to passengers with limited mobility and all such assistance will need to be provided by whoever the passenger is traveling with. Participants with disabilities must notify RIDE at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel.

FORCE MAJEURE

RIDE shall not be liable for any delay or default in performing hereunder nor shall they make any refund if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, insurrections, terrorism or civil disturbance, government restrictions, changes of schedules or operational decisions of air carriers, terrorist activity or the threat thereof, industrial action, natural or nuclear activity, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation, adverse weather conditions, fire, or for acts or omission of Third Parties or other parties and/or any other cause beyond its reasonable control.

SEVERABILITY

If any provision of these terms and conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.

CHANGES TO CONTRACT, JURISDICTION, AND CLAIMS

Changes to any portion of this agreement are invalid unless confirmed in writing by RIDE.

Any dispute related to the tour or rental shall be governed by Oregon law without regard to conflict of laws principles. The federal or state courts in Bend, Oregon, shall be the exclusive forum for any lawsuit related to the tour or rental, and you consent to the personal jurisdiction of said courts. You agree to present any claims against us within 30 days after the tour or rental ends and to file any suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. Guest claims not submitted and received within this time shall be deemed waived and barred.
